Terms of Service — Motika.IO

These Terms are a legal agreement between you and Media Group Motika LLC (“Motika”, “we”, “us”).
If you do not agree, do not use Motika.IO.

1. Definitions

• App: Motika.IO mobile application.
• Website: https://motika.io for uploads and service operation.
• Services: App + Website features, including viewing content, engagement, and account features.
• Content: videos, images, text, comments, links, metadata.
• User Content: Content you submit/upload/post.
• MPOW Points: off-chain points tracked on our servers (not a crypto wallet, not on-chain token in the App).

2. Eligibility

• You must be 13+ to use the Services.
• If you are under the age of majority where you live, you confirm you have the required permission to use the Services.

3. Accounts and access

3.1 Automatic accounts

We may create an account automatically when you first use the App (using an internal identifier). You may optionally add an email later.

3.2 Account responsibility

You are responsible for activity on your account and for keeping your device secure.

3.3 Suspension and termination (no-warning enforcement)

We may suspend, restrict, or terminate your account at any time, with or without notice, if we believe:

• you violated these Terms or Community Guidelines,
• you engaged in abuse/farming/manipulation,
• it is necessary for safety, legal compliance, or platform integrity.

4. The Service: what it is (and isn’t)

4.1 Viewing and engagement

The App allows you to view content and use engagement features (e.g., likes/shares) as enabled.

4.2 Uploads happen on the Website

Video uploads are performed via our Website (external link), not inside the App.
Your use of the Website for uploads is part of the Services and covered by these Terms.

4.3 We can change the Services

We may add, remove, or modify features. We are not obligated to maintain any specific feature or availability.

5. Community rules (summary)

You agree not to:

• violate laws,
• infringe intellectual property (copyrights/trademarks),
• post non-consensual personal content,
• harass, threaten, or target individuals,
• distribute malware/spam,
• manipulate metrics/rewards (bots, farms, multi-account abuse),
• evade enforcement.

Full rules are in Community Guidelines and incorporated by reference.

6. User Content: rights, responsibilities, license

6.1 You own what you upload (but you must have rights)

You retain ownership of your User Content, but you represent and warrant that:

• you own it or have all necessary rights/permissions,
• your content does not violate laws or third-party rights.

6.2 License you grant to Motika

By submitting User Content, you grant Motika a worldwide, non-exclusive, royalty-free, sublicensable license to:

• host, store, reproduce, distribute,
• display/perform, adapt/format,
• make it available to users in the App/Website, for operating, improving, and promoting the Services.

This license lasts until your content is removed from the Services, except we may retain copies for:

• legal compliance,
• dispute resolution,
• safety/abuse prevention,
• technical backups (removed on a reasonable schedule).

6.3 Removal and moderation

We may remove or limit visibility of any content for any reason, including enforcement, safety, or legal risk.

7. Intellectual property and takedowns

7.1 Platform IP

The Services, software, designs, trademarks, and logos are owned by Motika or licensors.

7.2 Copyright complaints (takedown process)

If you believe content infringes your copyright, email: davor.iliev@solutions.mk with:

• your name and contact info,
• the specific URL/content identifier,
• why you believe it infringes,
• proof of ownership or authority.

We may remove the content and may take action against repeat infringers (including termination).

8. MPOW Points (off-chain only, current state)

8.1 What MPOW Points are

MPOW Points are off-chain points recorded on our servers.
They are not money, not a bank balance, not a security, and not a promise of future value.

8.2 No in-app wallet / no on-chain claim

• The App does not display a wallet address.
• The App does not offer on-chain withdrawal/claim at this time.
• No KYC is used at this time.

8.3 Anti-abuse and forfeiture

We may withhold, adjust, or forfeit MPOW Points if we reasonably believe you:

• used bots, farms, multi-accounts,
• manipulated views/engagement,
• violated Terms/Guidelines,
• attempted to exploit system weaknesses.

8.4 Program changes

We may change earn rules, limits, or availability of MPOW Points at any time.

9. Advertising and promotions

The Services may include ads or sponsored content.
We do not guarantee outcomes for advertisers or users. Ad formats and placements may change.

10. Third-party services and links

The Services may link to third-party websites or services. We are not responsible for third-party content, policies, or practices.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
We do not guarantee uninterrupted service, availability, or error-free operation.

12. Limitation of liability

To the maximum extent permitted by law:

• Motika is not liable for indirect, consequential, or special damages.
• Motika’s total liability is limited to the amount you paid us for the Services in the last 12 months (if any), or a minimal statutory amount if required.

13. Indemnification

You agree to indemnify and hold Motika harmless from claims arising out of:

• your User Content,
• your violation of these Terms/Guidelines,
• your infringement of third-party rights.

14. Governing law and jurisdiction

These Terms are governed by the laws of Macedonia.
Courts in Skopje have jurisdiction unless mandatory law requires otherwise.

15. Changes

We may update these Terms. We will post the updated version with a new effective date. Continued use means acceptance.
